If you have been arrested for DUI in Pennsylvania, you will receive an automatic license revocation notice at the time of your arrest. In order to prevent your license from being revoked, you need to immediately request a DMV hearing. Because of our DUI legal experience, we can help you through this complicated process as well. In addition to making sure that your request is filed properly, we may even be able to take steps to enable you to avoid the need for a DMV hearing.

If you have received a notification from the PENNDOT that your driver’s license is being suspended, you have 30 days to request a DMV hearing.  If you request a DMV hearing within that time frame, your license suspension will not take effect until the hearing is held. If you fail to request a DMV hearing within 30 days, you will lose your license for 12 months. Time (and good advice) is of the essence!

It is important to note that this DMV hearing is completely independent of your criminal trial. Even if you’re found not guilty by the court, your license will be suspended for a year unless you request a DMV hearing. Because this hearing is considered administrative and not criminal, you are not given representation. If you want to be represented by counsel, you must bring your own DUI attorney. We encourage you to do so, because there are numerous details that must be handled during within a very limited amount of time. You do not want to lose your license for a year because of an error in paperwork. And yes, it does happen.

If you decide to go to the hearing without a lawyer, you will need the following:

Your request for a DMV hearing must be made in writing and must include:

• your name
• your driver’s license number
• your date of birth
• your mailing address
• your daytime phone number
• the address where documents and pleadings are to be mailed
• a statement of facts about your case
• the reason(s) for your request to keep your license
• a list of specific issues including what precedents your claim is based on and the desired outcome of your request
• a copy of the revocation letter given to you by the arresting officer
• a check or money order for the $100 filing fee

As you can see, this is a complicated process to take care of yourself. An experienced DUI attorney can make sure you have all of your papers in order.
