“When it was time for me to obtain legal counsel, I received tons of letters from various DUI attorneys in Pennsylvania throughout my surrounding area. I decided to make calls to everyone who sent a letter in order to try and make a decision about my representation. At times I reached someone right away and other times I went back and forth with someone for some time.Mike Logan & Associates stood out amongst everyone becasue they actively pursued me and showed a genuine interest in my DUI case. He listened to my story and my thoughts and concerns. When I told him that I didn’t have certain expectations of my representation, he stated back, “Well you should expect that from any PA DUI attorney!” I was very impressed and felt very confident he would do his best to work for my best outcome. And that is exactly what he did.Mike Logan was completely responsive to my needs – ensuring that my questions were answered and phone calls and emails addressed. The experience of working with Mike Logan & Associates was overall satisfying and exactly what I came to expect! ” – Posted By Jason

“I owe a huge thank you to Mr. Logan for how he handled my case and helped me out of a sticky situation. Without discussing the details, the case against me was shaky at best and within minutes of sitting down with the arresting officer and the idea of a plea deal coming up, Mr. Logan told the officer that he would love to take this case to a trial, the officer looked at his papers, then at Mr. Logan and said “I don’t want to go to trial against you with this shaky case. I know you.” And I could not be happier to have had Mr. Logan there for me to speak for me with these people who clearly respected him. Mr. Logan exhibits a contagious confidence that seems carries over into his cases confident in his work and his case that he will win for you. And he will also be very kind and pleasant for you to deal with. Upon our first meeting and asking about myself, after fining out I play hockey, Mr. Logan offered me a pair of tickets to a flyers game for trusting him with my case. And as I’ve said I am happy that I trusted him as well. If you choose Mr. Logan you will leave your first meeting with him as confident as I was that you chose the right guy.” –Posted By David

Frequently Asked Questions

If an officer asks me to take a field sobriety test, should I?
You are not legally required to take a field sobriety test (walking a straight line, standing on one leg, etc.) and it is probably the best course of action to respectfully decline to do so. If you are asked to take a Breathalyzer test, you should do so, or you will face penalties if you refuse that can be worse than taking the test and failing it. By accepting the privilege to drive, you have given your consent to submit to an approved chemical or physical test of your breath for the purposes of determining your BAC.

I failed the field sobriety test – can you help with that?
By viewing the police videotape and even taking independent pictures of the scene, a DUI attorney can show that ground was uneven, the officer’s instructions were unclear or their descriptions were inaccurate, etc. There are also numerous other factors such as your weight or other health conditions that can lead to failing a roadside sobriety test.

Does the car have to be moving for me to be guilty of DUI?
No. You only have to have “the capability and power to dominate, direct, or regulate the vehicle.” Courts have determined that simply sitting behind the wheel with the keys in the ignition can cause you to be arrested for DUI in Pennsylvania.

The Breathalyzer said I was drunk – how can I challenge that?
No machine is perfect; in fact, they break down all the time. An experienced DUI attorney can review the calibration and maintenance records of the machine used to test your blood alcohol content – and may be able to suppress the evidence from the machine. This could result in your case being dismissed.

They gave me a blood test, and I failed. What can a lawyer do?
An experienced DUI attorney will retest the blood by a private lab, and can even hire an analyst to determine if your blood alcohol concentration (BAC) was rising. This might prove that that your blood alcohol content was lower when you were actually driving. This could put you under the legal limit or at least reduce your level of intoxication for sentencing purposes.

What causes police officers to suspect drivers of DUI?
According to the National Highway Traffic Administration (NHTSA), the following is a list of behaviors that may indicate driving under the influence:Turning with a wide radiusStraddling center of lane marker”Appearing to be drunk”Almost striking object or vehicleWeavingDriving on other than designated highwaySwervingSpeed more than 10 mph below limitStopping without cause in traffic laneFollowing too closelyDriftingTires on center or lane markerBraking erraticallyDriving into opposing or crossing trafficSignaling inconsistent with driving actionsSlow response to traffic signalsStopping inappropriately (other than in lane)Turning abruptly or illegallyAccelerating or decelerating rapidlyDriving with headlights off
